Dear Sir, I am working as a senior health care assistant in the UK. My employer is paying me £7.16 per hour. I work more than 50 hours a week normally. Am I getting the correct pay for my work? If my employer is not paying me the right wages can I complain?

Thanks for your query.
As per the current rules experienced senior care assistants must be paid £7.80 per hour. This payment is mandatory in line with the current Tier2 code of practise and standard occupational classification.

It is illegal for any employer to enter into a contract with a migrant employee to agree a lower hourly payment. You are entitled to claim the difference through appropriate legal actions. I would advise you to obtain advise from a solicitor.

If you cannot prove that you are not getting paid appropriately in line with the Tier2 code of practise then you will not be eligible for Permanent Residency when you complete 5 year stay in the UK.It may be worth moving to a new employer who would pay the appropriate salary. You should take independant legal advise before taking any decisions.
