dear sir, I had a car accident in 2012 nov ( a man jumbed into the car, hit in the passenger side below the windscreen and got injured his leg). I called the police and ambulance. police done the breathing test and there wasn't any problems. The insurance company told me that the other parties soliciter climing 90/10 liability in their clints favour. so they ask me wether Iam willing to go to the court. iam working as a nurse. is it affect my job.is there any hidden problems if I goto the court. please advise me thank you for the help. George.

Dear George,

Thanks for your query.

From the information I understand that the other party has claimed against you and the matter is currently under negotiation for settlement. Most of the Personal Injury cases reach a settlement before issuing proceedings in the court.
90/10 offer means they are putting you 90% responsible for the accident and the claimant 10%. It would be in the interest of your insurance company to contest the case with the aim of reducing your % of liability for the accident and accordingly a lesser settlement figure. The strength of your case would depend upon the strength of evidence and insurance companies would not normally decide to contest a case unless they are confident about their position. They will have their solicitors who will defend their case.

Attending a court in regards to this matter would normally cause no problems especially in regards to your employment. Good luck to you!
