Hello, Sub: Query regarding ILR eligibility. I have been with UK since 2nd May 2010. My ICT visa stamped from Bangalore on 23rd March 2010. I have changed my visa from ICT to Tier 2 general on April 2013. I have a break of 110 days (between 10-June 2012 and 30 Sep 2013) from UK. Could you kindly let me know whether I am eligible for ILR in UK by May 2015 ? Note : In fact I have met with an accident from India while I was on vacation in July 2012 . Appreciate your response. Dear Sajesh

I understand that you were able to switch into Tier2 general as you were granted entry clearance as a Tier 2 (Intra company transfer) under the Immigration Rules in place before 6 April 2010 and you applied to change sponsor.

As per the current rules you should be able to apply for ILR on or after 05/03/2015 provided you meet the requirements in force at that time.

In regards to the absence periods from the UK the current rule allows you to be away for from the UK for up to 180 days in a year. Only if you were away from the UK for more than 180 days then they will see if there were any compassionate circumstances for such longer absence.

Whilst it is not necessary in your case to provide any evidence for such absence it may be a good idea to get a confirmation from your employer that the Holiday/sick leave was authorized by them.
